scandal. jerry sandusky in and out of court in minutes waiving a preliminary hearing and keeping accusers from taking the stand. afterwards we heard a few hints about his defense strategy. joining us now is jerry sandusky's attorney joe amendola. thank you for joining us this morning. >> good morning, carol. thank you. >> i think a lot of people are still confused about why you decided to waive the preliminary hearing. so tell us why. >> the answer is simple. monday night the attorney for the commonwealth contacted me to discuss details about the preliminary hearing. during those conversations i had with him, he indicated he would ask the judge following the preliminary hearing to increase bail. i've always been concerned that jerry might wind up in jail pending his trial, which would really impede our efforts to adequately and properly prepare his defense. it's very difficult to work with a defendant when he's incarcerated. so we began discussions about making concessions. us waiving the preliminary hearing in return from the commonwealth saying to us, guaranteeing, they would not seek i

penn state football coach jerry sandusky is adamantly denying allegations her husband abused young boys. sandusky was released last night on bail after two new accusers stepped forward. he's under house arrest facing criminal accusations from ten young many and facing more than 50 counts. his wife dottie says i have been shocked and dismayed by the allegations made against jerry. i continue to believe in injury a's innocence and all the good things he has done. i am joined by chuck schmidt, one of the young man alleging abuse. your client is a 19-year-old young man who ways safes sexually abused by sandusky in 2004. what specifically are the allegations that your client has come forward with? >> tom, thank you for having me. he was a participant in the second mile program in 2004. at that time after an activity, a planned activity, he was taken back to mr. sandusky's office in one of the athletic facilities, and he was given alcohol and then a sex act was performed upon him. >> when you talk about alcohol being given to this young man on the campus of penn state, we've heard a lot of th
about the ninth accuser, what exactly is he sayisay saying jerry sandusky. what he's saying is slightly different than what the other accusers have said. he said he was a second mile camper staying at second mile facilities in 2004 when he was 12 years old. he was in a swimming pool with jerry sandusky and other kids, was then separated from the other children, taken on a four with jerry sandusky, taken into the football building and into an office in that football building where jerry sandusky gave him whisky and he molested him just before he went back to camp. he was a second mile child and that's consistent with all of the other accusations, all oath other accusers have been second mile children. >> sarah. thank you very much. especially given the alcohol involved. let's bring in cnn legal corporate paul callan here, the fact that there was whisky involved, just strikes me even more than just the facts itself. explain how this happens when another accuser comes forward. >> it's not uncommon at all in these child abuse cases. i think we're up to 13 claimed victims in this case. peopl
situation where kids were playing in a pool with jerry sandusky, was later separated from that group and taken on a tour by jerry sandusky of the football building. now, a lot of other incidents have happened at that football building, but all of them have been alleged to have happened in a shower. this man is saying that he was taken to an office. he was given whiskey and he talked to sandusky about his life and how he ended up at the second mile and then he was assaulted before jerry sandusky took him back to the dorms. >> we know jerry sandusky has a number of charges against him already. with these new claims about sandusky, will additional charges be pressed against him, sara? >> don, that's hard to say. you know, there have been, by my account, five people have come forward since the initial charges were filed and made public allegations against jerry sandusky. they are, the majority of them, as far as we know, have also talked to the attorney general's office and given statements to police. however, it's hard to know if they are, if they are actually going to lead to charges.
three years. that interview's coming up in the next hour of newsroom. >>> the lawyer for jerry sandusky, the former penn state defensive coach says the time may come when his client has to think about a plea deal. that's right, the lawyer says that a plea could happen if more people come forward claiming that sandusky molested them. he told cnn contributor sarah began number that such a scenario could make this case an uphill battle. >> reporter: what is the point where you say should we talk about a plea deal? are you having those conversations? >> no, we haven't. as a matter of fact you know from your experience, sarah, that people who maintain their innocence sometimes plead guilty because of the overwhelming evidence against them. there are many people who have gone to trial who were convicted of very serious crimes, including homicides, and executed and it later turned out that they were innocent. there's a lot of reasons why people decide to do certain things, but at this point jerry has maintained his innocence in regard to the allegations he knows about. >>> penn state students
